RENTAL AGREEMENT
The Playdate Playhouse
Rental Agreement
by Wiggs and Wiggs, LLC
By completing your booking through Acuity, you agree to the following Rental Agreement. No signature is required when booking through our online system.
1. Booking & Payment
A non-refundable retainer of 50% is due at booking to reserve your date. Final balance is due no later than 14 days before your event.
A $200 refundable damage deposit is due no later than 14 days before the event. Damage/cleaning deposits are returned within 3–5 business days of takedown if all items are in great condition and clean.
For bookings made within 14 days of the event, the full balance is due at the time of booking. All payments are non-refundable. However, you may reschedule once within 6 months with at least 24 hours’ notice, subject to date availability. If your final payment is not received by the deadline, your booking may be released and payments forfeited.
2. Cancellations & Rescheduling
You may reschedule your booking once with at least 24 hours’ notice, applying your payment to a future booking within 6 months, subject to availability. If you cancel with less than 24 hours’ notice or do not reschedule within 6 months, your payment is forfeited.
3. Weather Policy
If unsafe weather is forecasted:
- You may use your indoor backup location (on property or within 10 miles) at no charge.
- We’ll attempt to modify the setup to fit if possible.
- If setup is not possible, you may reschedule once within 3 months, subject to availability.
Refunds are not issued for weather-related changes. Additional delivery fees may apply.
4. Delivery & Setup
We arrive 1.5–2 hours before your event. You are responsible for:
- A flat, clean, dry setup space (grass, turf, concrete, or indoor flooring)
- A clear and safe path with no stairs unless pre-approved
- Shade or covering for outdoor setups
A $50–$100 access fee may apply if stairs, elevators, or long-distance carries are not disclosed. If the setup area is unsafe and no alternative is available, setup may be denied without refund.
5. Play Rules & Safety
Our play zones are for children ages 6 and under. Adult supervision is required at all times. Unsafe conditions may result in early takedown with no refund.
Rules:
- No shoes (socks required)
- No food, drinks, or pets
- No sharp objects or messy materials (paint, glitter, playdoh, etc.)
- No roughhousing or unsafe play
- Max weight: 150 lbs in bounce house
6. Cleaning & Damage
Excessive mess may result in a $50–$100 cleaning fee. Lost or damaged items will be billed at full replacement value. The damage deposit is refunded within 3–5 business days if no issues are reported.
7. Inflatables & Wind Safety
Inflatables cannot be used outdoors in winds exceeding 15 mph per Georgia law. If wind becomes unsafe, we may cancel or relocate the inflatable indoors. No refunds are issued for partial setups or early removal.
8. Liability Waiver
You accept full responsibility for supervising children and guests using the equipment. You release Wiggs and Wiggs, LLC from liability for injuries or damages during the rental. Participation involves risks, and you assume full responsibility for any such risks. Please review and sign the full participation and liability waiver prior to your event.
9. Photo Release
We may take photos of your event setup for marketing. No names, faces, or identifying details will be shared without written permission. Notify us in advance if you prefer no photos.
10. Venue Approval & Access
You are responsible for securing venue permission and providing accurate access info. No refunds will be issued due to venue restrictions or undisclosed access issues.
11. Time Overage
Events that run over and delay takedown may incur a $50 per half hour fee.
12. Safe Working Environment
You agree to provide a respectful, safe environment for our staff. If unsafe or inappropriate behavior occurs, we may pause or cancel service without refund.
13. Limit of Liability
Our maximum liability is limited to the total amount paid. We are not responsible for indirect or incidental damages.
14. Force Majeure
If an unforeseen event prevents us from fulfilling the service, you may reschedule once within 3 months. No refunds are issued due to force majeure.
15. Governing Law
This agreement is governed by Georgia law. Legal disputes shall be resolved in Gwinnett County, Georgia.
16. Indemnification
You agree to indemnify and hold harmless Wiggs and Wiggs, LLC from any claims or damages arising from your event, unless due to our proven negligence.

PARTICIPATION AGREEMENT AND LIABILITY WAIVER

Participation Waiver and Release of Liability
by Wiggs and Wiggs, LLC
This Waiver and Release (“Agreement”) is entered into by and between the undersigned (“I” or “me”) and Wiggs and Wiggs, LLC, doing business as The Playdate Playhouse (“Provider”). This Waiver and Release pertains to participation in activities and the use of soft play equipment and inflatable rentals provided by The Playdate Playhouse (the “Activity”).
Acknowledgement
BY BOOKING ONLINE OR SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ THIS WAIVER AND RELEASE, FULLY UNDERSTAND ITS TERMS, AND AGREE TO GIVE UP SUBSTANTIAL RIGHTS, FREELY AND VOLUNTARILY, WITHOUT INDUCEMENT.
IF THE PARTICIPANT IS UNDER 18:
I affirm that I am the parent or legal guardian of the child(ren) under my care, and I am signing this Waiver and Release on their behalf.
1. Assumption of Risk
I acknowledge that participation in the Activity may involve inherent risks, including but not limited to accidents, injury, property damage, illness, or in rare cases, death. I understand that these risks may result from my own actions or inactions, the actions of others, the condition of the equipment or venue, or unforeseen circumstances.
I voluntarily choose to participate (or allow my child(ren) to participate) in the Activity and assume full responsibility for any and all risks, whether known or unknown.
2. Safety Instructions
I agree to comply with all written and verbal instructions from Provider and its representatives. If I observe any unsafe condition or potential hazard, I will immediately notify Provider and discontinue participation until the issue is resolved.
3. Release of Liability
I hereby waive, release, and discharge Wiggs and Wiggs, LLC (The Playdate Playhouse), along with its owners, employees, contractors, agents, affiliates, and successors (“Releasees”), from any and all claims or causes of action arising from or related to the Activity, including but not limited to those arising from ordinary negligence.
I agree not to bring or pursue any such claim against any of the Releasees, and I release them from all liability to the fullest extent permitted by law.
4. Waiver of Unknown Claims
I understand that this release is intended to cover all claims, even those I may not currently know or expect to exist. I waive any protections under state laws that would limit this release to only known claims at the time of signing.
5. General Provisions
This Waiver and Release is governed by the laws of the State of Georgia. Any legal disputes shall be resolved exclusively in the courts of Gwinnett County, Georgia.
If any part of this Agreement is found to be invalid or unenforceable, it shall be severed, and the remaining terms will remain in full force and effect. This Waiver and Release is binding on me, my heirs, legal representatives, and assigns.
